The New York City police officer from Center Moriches who is accused of killing his 8-year-old autistic son has resigned from the force.

Michael Valva was suspended without pay when he was arrested in January. By resigning, he gets to keep his pension, and he will not face an NYPD disciplinary hearing. He also will not receive any future benefits.

Prosecutors said Valva withheld food from his son Thomas and forced him to sleep in an unheated garage during winter. Thomas died of hypothermia in January.

Valva has pleaded not guilty.

A Suffolk County judge will hear arguments in December on whether controversial statements Valva made to police will be allowed at trial.
