Voting Twice Is Legal In New York, But Only One Will Be Counted

President Trump told voters in North Carolina to vote twice: by mail and then in person on Election Day. That is illegal in most states. However it is legal in New York, with the in-person ballot being the one that will be counted.

Suffolk County Election Commissioner Nick LaLota says voters who vote by absentee ballot but then decide they’d rather vote in person can do so. The absentee ballot will be discovered by a bipartisan team of election officials and thrown out, and the in-person ballot will be counted.

“That is the prevention to somebody voting twice. But nobody should be fearful that they're committing a crime or doing anything wrong,” he said.

The Election Commission cross-checks absentee ballots against early voting and Election Day ballots to make sure no one voted twice - that’s one reason why counting absentee ballots does not begin until 7 days after Election Day.

Election Commissioner Anita Katz says more than 300 absentee ballots cast in the June primary in Suffolk County were discarded after officials discovered those same voters also cast an in-person ballot.
