AG Should Appeal Tweed Airport Ruling To Supreme Court, Say Conn. Senators

The top Democrat and Republican in the Connecticut Senate are against a federal appeals court decision that allows for a runway extension at Tweed-New Haven Airport.

Senate President Martin Looney and Senate Minority Leader Len Fasano sent a joint letter to state Attorney General William Tong urging him to appeal the decision to the U.S. Supreme Court.

Looney is concerned that the Second Circuit Court of Appeals decision preempts a state statute that limits the length of the runway. He says other circuits have ruled differently on such matters.

“There is a greater likelihood that the U.S. Supreme Court will accept a case when it can resolve a conflict in the circuits as it exists in this matter.”

Tong says his office will review the legal issues to determine the best course of action.

Residents near the airport oppose the runway extension. New Haven City Mayor Toni Harp says the project will help economic development.

Connecticut has less than three months to decide whether to file a U.S. Supreme Court appeal.
