A New York State Supreme Court judge has ruled unconstitutional the state’s ban on live music advertising from bars and restaurants.

The State Liquor Authority had ordered that live music could not be advertised or ticketed. Performing acts could only be “incidental.”

The judge wrote that there is no real difference in promoting a menu special or live music.

Venues will now be allowed to advertise live music, sell tickets and charge a cover.

The state is allowed to appeal the ruling.
